OSHA has announced that it plans to publish a Notice of Proposed Rulemaking in August 2016 that will increase the maximum penalty amounts that can be assessed against an employer for violations of the OSHA law and regulations.
OSHA State Plan States, such as Maryland, will have to adjust their maximum penalties to the new Federal levels.
Arguably, this action could financially disproportionately impact smaller businesses, such as the average funeral home.
OSHA, to date, has not published any specific information as to the extent of the proposed increase. The impact on small business should be addressed nationally once the increase is officially announced by OSHA.
